The LİHKAB Law changed in 2021
What has changed in the LİHKAB Law? What does the amendment mean for licensed surveying and cadastre offices? How will the new arrangements work?
The LİHKAB Law has changed. This amendment has raised the hopes of young surveying engineers. Thousands of young people hoping to work in LİHKAB offices have begun asking when recruitment will take place. Many vacancies are expected following this recent change, although the extent of demand is not yet known. The details of the amendment are set out below.
The LİHKAB Law, which has been debated for many years, has pleased some while leaving others concerned about the new arrangements. The law has been amended several times, and officials consider the latest change fairer. Existing LİHKAB offices, however, have expressed concern about potential difficulties in implementation.
Once the law takes effect, the number of offices and employment of surveying engineers are expected to increase. The currently limited number of LİHKAB offices could reach several thousand across Türkiye. This would give citizens more licensed surveying and cadastre engineering offices to choose from and prevent authority from being concentrated in a single centre. Service quality and satisfaction are expected to improve. The experience and examination requirements for LİHKAB have also changed.
The amendments to the LİHKAB Law can be summarised as follows: licensed surveying and cadastre engineering offices will carry out and check cadastral technical services not subject to registration, including setting out parcel boundaries, showing locations and providing plan copies. They will be responsible for services subject to registration, including changes in property classification, establishment or cancellation of land easements, parcel amalgamation and removal of records of improvements, as well as other cadastral technical services designated by the General Directorate of Land Registry and Cadastre. Licensed surveying and cadastre engineers may also provide independent surveying, cadastre engineering and consultancy services while operating their licensed offices. The experience required to obtain a licence will increase from five to ten years, and the examination requirement will be abolished. Licensed surveying and cadastre engineering offices may be opened and operated only by licence holders.
Licensed offices must employ at least three people qualified as engineers, higher technicians or technicians in relevant fields; at least one employee other than the licence holder must be an engineer. You can review the changes to the LİHKAB Law in the regulation published in the Official Gazette on 25 September 2021 here.
